How Will A Brain Injury Attorney Help Me?

We live in a compensation crazy word; fact! However, for every phoney claim there is a genuine one from somebody who has sustained serious injuries and who are claiming the compensation they are rightly entitled to. However, finding the best lawyer to fight your corner can be a minefield, especially if you have suffered a serious head injury. An Internet search for a traumatic brain injury attorney will give you a multitude of results, here’s how to find the best one for you.

What exactly is a TBI?

A TBI, or traumatic brain injury is the result of the victim’s head suffering a serious trauma. This can come from several sources including the head being struck by, or forcefully slammed into, a heavy object. Other impacts include those sustained in a car crash, being knocked off a bike or being hit by a moving car. Anything that can cause the brain to be slammed against the skull has the potential to cause severe, long lasting damage. If it is serious enough the injury could result in permanent brain damage.

What are the side effects of a TBI?

These very much depend on the severity of the injury, how quickly the victim received medical attention and how they respond to treatment. If, for example, somebody suffers a TBI whilst playing a contact sport they will invariably receive help quicker than somebody who falls off a ladder and is knocked unconscious when home alone. A few of the many side effects of a traumatic brain injury are:

  • Slipping into a coma
  • Altered speech
  • Changes in behaviour, such as becoming more aggressive
  • Loss of judgement, reasoning or memory
  • Unable to concentrate
  • Chronic insomnia
  • Headaches

What Will my Lawyer Do For Me?

Your lawyer will work to the best of his or her ability to ensure you receive the compensation you deserve. As TBI cases are more difficult than most we cannot stress how important it is that you engage the services of an attorney who specialises in traumatic brain injuries. In many cases the victim is unable to instigate the case so the next of kin has to do it on their behalf. Your lawyer will be used to this and will work with your representative.

What Compensation Can I Claim?

Once again, this is dependent upon the kind of TBI and the resulting damage. Do your doctors expect you to make a full recovery in time or have your injuries left you with permanent damage? Are you claiming medical expenses, loss of earnings, the cost of treatment and rehabilitation? All of these have a bearing on the case and will be explained at length by your lawyer. If the TBI results in loss of life the next of kin are entitled to file a lawsuit for wrongful death and receive compensation for any medical bills incurred, funeral expenses and possibly loss of support and companionship.

Time is of The Essence

It’s accepted that you might not be able to start your claim immediately but the sooner you, or your representative engages the services of a lawyer the better. Not only will it mean your compensation is paid out quicker but if the case is reliant on witness statements these will be fresh in their mind whereas months down the line small but important details could be forgotten.
